It is not correct.  There is no general law covering all 
cases of ownership.  For example, in many cases transfer of 
title doesn't occur until an item has been received and 
inspected.

Legalities aside, no reputable company is going to hold a 
consumer responsible for an item that it fails to deliver to 
the customer.
