Well, maybe. According to you or me, yes. Our all-wise and paternalistic
USF&WL people say no, emphatically. 

They have a bureaucracy to protect, and all we want is to save a few fishes.
The difference is sometimes astonishing.

Since they issue the permits, guess who wins? ;-)
