Edd is right about this. Go to a local private club and try to get in to
have a few beers without paying dues or being approved. This is a no
brainer. But I guess it can be misconstrued if someone wants to do it.
Really though, the big deal is the same people list in the BNL month after
month after month after month after month after month..................

Good grief, where is our leadership and why don't they understand our
guidelines?
It's been a while since I had a copy of the BOT guidelines and I realize
that they've been "messed with" in the past few years, but somewhere it
must
state that listing in the F&EL is a "PRIVELEGE of being a member. It's
always been AKA policy that the BNL F&EL was for members only. Only
members
can be required to follow the COE and that's a REQUIREMENT for listing.

I think the doubt applies to a company or institution open to the public
but
not private clubs unless discrimination is based on ethnicity, origin,
color, economic status, or other violation of environmental justice in its
legal sense. Newspapers can refuse advertisements for numerous reasons,
including offensiveness to the community.

I can find no reference in the by-laws that speak to this issue. As the
by-laws are the only binding document governing the AKA, that makes a
definitive answer difficult. The by-laws stipulate that members must
abide
by the Code of Ethics, but the latter also do not indicate who can list
in
the BNL.
Having said that, it has always been my understanding that listing in the
BNL's F&EL was a privilege of membership and for that reason I stated
that
on the web site, although I note that it is not stated in the BNL itself,
at least the recent ones.
Transactions initiated through the BNL are the only ones that are
protected by the AKA Code of Ethics and transactions involving
non-members
are explicitly excluded from such protection in the CofE. That would lead
me to believe that only members should list in the BNL but I'm not sure
we
have a "legal" right to refuse non-members.
The By-laws and Code of Ethics are available on the AKA web site if you
wish to peruse them.
