Sorry about the shorthand. It was widely believed that when the Endangered Species Act was passed that it was OK to keep an endangered species you already had because the Act somewhere concealed a "grandfather clause" that made such retained species legal. Descendants were also supposed to be legal. It was a myth.


There is no such provision, and keeping certain pupfish is now, and was immediately upon its signing, quite illegal. Do not pass "GO." Do not collect $200. And, for sure, do not try to keep most pupfish from the southwest or springfish without a federal permit.

The first few permits issued were (except by Al Castro) so abused and the hobbyists were so derelict in reporting that they seem to have poisoned the well for all of us. As a result, it has become nearly impossible to get a permit to keep the fish, and really impossible to set up any legal joint breeding or maintenance programs involving groups. :-(
