The amended complaint, written by the author of the above, reads in part as
follows:
"Upon information and belief, at all times hereinafter mentioned, defendants
"John Doe" and "Mary Roe" . . . are any and all individuals who participated
in the unlawful conduct complained of herein Computer fraud; Trademark;
Tortious Interference; Civil Conspiracy; Product disparagement; Linking;
Defamation; False Light; Invasion Of Privacy; Intentional Infliction Of
Emotional Distress, Harassment; Libel; and Trade Libel."
It has been said before, but it's worth repeating: "John Doe" and "Mary Roe"
are people subscribed to chat boards and lists such as the APD (Manny
excluded). In other words, Novak is suing anyone and everyone who he
believes has committed any of the above acts. It doesn't matter if he's in
la-la land or not: if Robert Novak sees fit, he considers you a defendant.
Anyone out there feel a little bit apprehensive about speaking your mind
about Novak or his business? (No, I'm not talking about shills like you,
Manny.) You should. I do. It's understandable; most of us have lives which
are complicated enough without having to contend with some psychopath going
after us with lawsuits. I've seen many, many people express similar
sentiments. Here's one example I found on a chat board:
"Ok, I'm a little worried. I have never shopped at petSwarehouse. The truth
is, now I'm scared to. Not because I believe or don't believe thier customer
service is bad, but because if I have a problem with them, and I voice my
concerns - what will happen to me? I am a stay at home mom, and have no
income not including my husbands."
and another (this person claims they were ripped off by Pets Warehouse):
"I'm a full-time mom and I've stayed quiet about the whole thing because I
don't want to deal with the hassle of a lawsuit or even lose any much-needed
sleep over boorish threats... And I have the type of personality where I
would lose DAYS of sleep over a one-liner "threat.""
Novak initially asked for $15,000,000. For his efforts to-date, RN has
gotten a few months of free web banner space on eight or nine web sites,
about $4000 from one defendant, has taken another defendant's domain name,
and has intimidated many people into having second thoughts about speaking
their minds.
Ask yourself some questions:
What kind of person would rather expend enormous effort to file a lawsuit
than the small amount of effort it would take to resolve the customer
service issues with a simple refund?
What kind of person thinks fostering these feelings in others is beneficial
for his business?
What does Ms. VanDersarl's "plantedtank.com" domain (which she forfeited)
mean to Novak? What did it mean to her?
Who "sucks" here?
