OT: more lawsuit stuff
I'm of two minds about all of this. First off, I believe very
strongly that people should be able to relate their experiences
with vendors here, if only to answer the question, "hey, i was
thinking about buying plants from www.randomplantsouce.com, what
are they like?"
I think we should be allowed to criticize businesses that have
left us unsatisfiedwithout wondering quietly if our language was too
strong, or if maybe by using the word "revenge" in our post (for example)
we have have gone too far. That alone would have enough of a chilling
effect on free expression that it would pretty much shut it down.
At the same time, I think a lot of folks here are shooting their
mouths off. You don't know what it would take to mount a countersuit
unless you've done it yourself or are a lawyer. Making idle jokes
about sending mafiosos over to pay Novak a visit seems harmless, but
such comments will be shown to the judge *without proper context*.
Has it occurred to anyone that perhaps Novak is goading us into
saying something awful that will get a judge's attention? Or at
least produce such a volume of negative "you suck", "we'll run you
out of business", "we'll countersue until the world ends" comments that
the judge might actually listen to the idea that APD is out to get him
and his business?
I think it's fine to criticize petswarehouse and any other business,
but I think we should stick to the facts and not make bravado-laden
comments about how the great hand of justice will crush him. We'll
just be making more trouble for everyone that way, and clog the
list with the fallout.
I'm confident that the lawsuit will fail. Precedent is on our side.
Keep talking about plants, keep people informed about the lawsuit, and
keep sending money to the legal defense. Don't say anything that will
give novak an edge, it might make you feel good but could be twisted
in court.
